ment of the ſaid Fine, the Charges of Recovery, and of
making good the ſame, without regard to any Right the
Landlord or other Party may have or pretend to have
therein, upon any Account whatever; and in caſe no ſuch
Effects be found, or that the Effects actually found ſhall not
produce the Amount of the ſaid Penalty and Charges,
then the Heritors of the Pariſh in which the Offence has
been committed, ſhall be obliged to pay the Whole of
the ſaid Penalty, or to make up the Deficiency thereof,
as the Caſe may happen; as alſo in the Caſes where the
ſaid Heritors ſhall be liable or ſubjected, it ſhall be optional
to the Board of Exciſe in Scotland, or to the Pro=
ſecutor at whoſe Inſtance Execution iſſued, to ſue any
Three of the ſaid Heritors they or he may judge proper,
for Payment of the ſaid Fine, or Remainder of Fine,
and Charges attending the ſame; and the Heritors mak=
ing Payment ſhall have Recourſe and Relief againſt all the
other Heritors in the ſaid Pariſh, and each of the ſaid
Heritors ſhall pay according to the Proportions, and in
the ſame Method, as that by which the Stipend of the
Miniſter is levied and paid; providing alſo, that the Perſon
who holds the Execution or Diligence againſt the ſaid Ef=
fects, and is intitled to levy the ſaid Fine, may bring his
Action, and is to have Execution againſt any Three of the
ſaid Heritors, jointly or ſeverally, for Payment of the
Sums due; and upon Payment thereof, the ſaid Heritors
ſhall have Recourſe againſt the other Heritors of the Pariſh
for their reſpective Proportions of the ſaid Sum; and
the ſaid Heritors, upon Payment, ſhall have Action
againſt the Perſon and Property of the principal Of=
fender; which Offender upon ſuffering himſelf to be
impriſoned therefore ſhall not be entitled to the Benefit
of Ceſſio Bonorum, neither ſhall the Burghs be at Li=
berty to diſcharge the ſaid Perſon or Perſons, in virtue
of the Act of the Parliament of Scotland, commonly
called The Act of Grace, or any other Privilege of the
Law, but the ſaid Perſons ſhall ſuffer Impriſonment
as fraudulent Offenders againſt, and Debitors to, his
Majeſty's Revenue; as alſo providing that it ſhall be
