derick and Edmund Hoskins and the Survivor of
them and the executors and Administrators of such
Survivor shall and do retain and with hold the
same in their or his Name hands or power until
such time as the said John Duke of Athole his
heirs executors or Administrators shall at his or
their own Charge or Expence have caused and
procured due and careful Search to be made by
some proper person or persons in the proper Office
or Offices in Scotland for the purpose of knowing
whether the Estates conveyed by the said Duke
unto them the said Sir Charles Frederick and
Edmund Hoskins and their heirs as aforesaid or
any part thereof are or is subject to any Charge
or Incumberance whatsoever other than and
besides the said Heritable Bond for the Sum of
seven thousand pounds and the said life Estate
of the said Mary Duchess Dowager of
Athole in such parts of the said Estates as
aforesaid and until such time as the said John
Duke of Athole his heirs Executors or Admi-
nistrators shall have produced and shewn
to the said Sir Charles Frederick and Edmund
Hoskins or the Survivor of them or his Executors
or Administrators an Affidavit or Certificate
of the person or persons who shall have made
such Search declaring and specifying what
shall or may have appeared to him or them
