the said Governor that he might acquaint the said John Taubman thereof
if he thought proper — And the Defendant further Admits that he delivered
one or more Draughts of the same kind to the said Governor after he the said
Prosecutor was appointed Deemster in Chief; And the Defendant hath the
same ready to be produced upon this Trial as shall be directed And
submits the same to the Judgment of this Honourable Court— And this
Defendant doth further admit that he likewise told his Honour that the
said John Taubman was no sooner Captain of Derby fort and Howard than
he smugled a Box of Silk Handkerchiefs a shore without Entry or paying His
Graces Duty, which before the said prosecutor knew of this Defendant
repeated to his Grace before his Honour— And this Defendant saith that
he received Information thereof from the Deputy Searcher of the said
port when the same happened And as the said prosecutor deny'd the fact before
his Honour as aforesaid this Defendant lately searched the Custom Books
and finds that the said places becoming vacant in July 1755 the said
prosecutor applied for them and had His Grace's Approbation And Commissions
being sent to Scotland His Grace signed & executed them on the fifth day of
November 1755 and returned them to this Isle— That the said prosecutor John
Taubman upon the 12^th December following above a Month after the Date of
his said Commissions and many Months after he had an Assurance of the same
Intred of board the friendship Alexander Turnbul Master from Sales one
hundred and five pipes twenty Hogsheads and twenty four Quarter Casques
of Brandy and should then have regularly reported and entred his whole
property on board the said Ship. That upon the same Day M^r Philip finch
and on the 16^th M^r Robert Henedy entred their Silks on board the said Ship
But the said prosecutor John Taubman did not so much as report that he had
any Silks on board, but (as the Defendant was informed by the Deputy Searcher
as aforesaid) there being a Dispute or Disagreement between the said
prosecutor and the said Turnbul the Master It the said Turnbul made Discovery
and Information that the said prosecutor John Taubman had smugled a Box of
