seventy thousand pounds hath been really
paid unto the said Duke on his executing
such Conveyance But part of the said Estate
so sold and conveyed being subject to a certain
debt Charge or Incumbrance due by heri-
table Bond or Obligation to the heirs of the late
Duke of Douglass for the principal Sum
of seven thousand Pounds lawful Money of
Great Britain but which Incumbrance
cannot be immediately discharged by reason
that the Persons entitled to receive and dis-
charge the same are not at present resi-
dent in Scotland, it hath been agreed that
the sum of seven thousand Pounds part of
the said Sum of seventy thousand Pounds
should be withheld by the said Sir Charles
Frederick and Edmund Hoskins until such
Incumbrance shall be discharged and the said Estate
exonerated therefrom And there not having
been sufficient Time before the Execution of
the said Conveyance from the said Duke
to the said Sir Charles Frederick and Ed-
mund Hoskins to make Searches in the pro
per Offices in Scotland in order fully to satisfy the
said Sir Charles Frederick and Edmund Hos-
kins that no part of the said Estate is subject
to any other Charge or Incumbrance except a
Life Estate of Mary Duchess Dowager of
Atholl
