a pretended plea in the said Cause, whereto the Pet^r
having craved Leave to file his Replication in aid of
his said Claim his said plea & Replication were then
orderd to be argued together at a Consistory Court
held at K.K.michael on Monday the 15^th of April r
1765 and the pet^r having attended for that purpose
the hearing of the s^d plea & Replication was
then adjourned to a further Day and so continued
by adjournments to the y^th day of this Instant
may, when the same coming on to be fully
argued debated and discussed before your Rev^ces
in Court in the presence of the parties your
Pet^r moved that the Benefit of the said
Plea might be saved to the final hearing
of the without prejudice said Cause & that the pet^r might in the
mean time be at Liberty to examine witnesses in proof
of his said Claim & Replication as usual in
such Cases, but your Reverences declined &
refused to permit your pet^r the Liberty of
examining any witnesses in the said Cause
in proof thereof and your order made therein
bearing date the y^th day of may 1765, your
Reverences adjudged and decreed that the Def^ts
Christian Kelly's Plea was well founded and a
good Bar in Law to your Pet^rs being admitted to
the Probate of his said Claim, which your Rev^ces
orderd to be dismissed your Reverences said Court
