Value, to a Conviction for the Offence aforeſaid; then, and
in ſuch Caſe, the ſaid Buyer ſhall and may have and main=
tain his Action upon the Caſe at the Common Law againſt
ſuch Seller for the Money ſo paid, as for ſo much Money
received by the Defendant for the Plaintiff's Uſe; and,
upon obtaining a Verdict in ſuch Action, the Plaintiff
ſhall alſo recover his Coſts of Suit.

XIV. And be it further enacted, That no Diſtiller or Reſtrictions
Maker of Spirits ſhall ſell or ſend out any Spirits relative to the
whatſoever, of a greater Degree of Strength, for Home Strength of
Conſumption, than that of One to Ten over Hydrometer *Britiſh* Spirits.
Proof; and no Rectifier or Compounder of Spirits, whe=
ther he be a Maker of Spirits or not, ſhall ſell or ſend
out any Compounds, Britiſh Brandy, or other Spirits, of
a greater or higher Degree of Strength than that of
One in Ten under Hydrometer Proof; and if any ſuch
Diſtiller, Maker, Rectifier, or Compounder, ſhall ſell or
ſend out any Compounds, Britiſh Brandy, or other Spi=
rits, contrary to the Intent of this Act, ſuch Com=
pounds, Britiſh Brandy, and other Spirits, ſhall be
ſeized and forfeited.

XV. Provided nevertheleſs, and be it further enacted, Exception
That it ſhall and may be lawful for any Rectifier or with reſpect to
Compounder of Spirits, or any Dealer in Compounds, Spirits of
Britiſh Brandy, or other rectified Spirits, upon Condi= Wine.
tion of their keeping their whole Stock of Spirits of
Wine ſeparately and apart from their Stock of other
Liquors, but not otherwiſe, to call for and receive Per=
mits for ſending out Spirits of Wine of any higher or
greater Degree of Strength than that of One in Ten
under Hydrometer Proof, to any Perſon not being a
Maker, Rectifier, or Compounder of Spirits, ſo that
the whole Quantity of ſuch Spirits of Wine, to be ſent
to any One Perſon in the ſame Day, ſhall not exceed
One hundred and twenty Gallons; and the Officer grant=
ing ſuch Permits, ſhall therein expreſs the ſame to be
double Spirit, and ſhall debit the Stock of ſuch Rectifier,
Compounder, or Dealer, at the Rate of One hundred
and eighty Gallons of Britiſh Spirits, for every One
hundred
