same, obtaining the Charter or Charters thereupon, and taking
and recording the Infeftment, as before mentioned, and the
Authority of the Court of Session shall have been thereunto
interposed, the Lands and Heritages hereinbefore-mentioned,
parts of the said Entailed Estates of the said *John*, late Duke
of *Atholl*, comprised in the said second Schedule annexed to this
Act, as the same are contained, and otherwise described in the
Deed of Entail hereinbefore recited, shall be, and the same are
hereby vested in, and settled upon the said *John* Duke of *Atholl*,
and his Heirs and Assigns, in Fee Simple; and the same shall
from thenceforth be freed and absolutely acquitted, released,
exonerated, and discharged of, and from all Conditions, Provi-
sions, Declarations, Limitations, Clauses Irritant and Reso-
lutive, and others in and by the said Deed of Entail hereinbe-
fore in part recited, limited, provided, expressed and declared,
of and concerning the said Lands and Heritages, or any of
them, or any part thereof, which, from henceforth shall be at
the free and absolute disposal of the said *John* Duke of *Atholl*
and his aforesaids.

*Provided always*, and it is hereby expressed, provided and de- Entail not al-
clared, that nothing in this Act contained, shall be held or con- tered, except in
strued to alter, innovate, change or defeat the said hereinbefore in fectuate the
part recited Deed of Entail executed by the said *John*, late Duke Exchanges.

ed, except, and in so far as is necessary to carry into effect the
Exchange hereby allowed to be made.

*Provided also*, that nothing in this Act contained, shall be
deemed, taken, or construed to affect, prejudice, prevent, in-
jure, or impede any lawful Claim made, or which may hereafter
be made, by the Heirs of Entail, or any of them, under the
Settlement or Investitures of the Estates settled and Entailed
by the said *John*, late Duke of *Atholl*, or any of the Lands
and Heritages contained in such Investitures or Settlements, or
any of them, or the prosecution of any such Claims, or any
Right, Title, or Interest, which such Heirs of Entail, or any of
them, are or may be entitled unto under any such Investitures
or Settlements, or any of them, save and except, and it is hereby
declared and enacted by the Authority aforesaid, that from and
after the passing of this Act, and the carrying the Exchange
thereby authorised into effect in terms thereof, they shall not,
nor shall any of them, have any Claim, Right, Title, or Inte-
