Atholl in a small part thereof being all the
yearly value of one hundred and forty one pounds
four shillings and nine pence sterling Although
the said John Duke of Atholl and his Agents have
assured the said Sir Charles Frederick and Ed-
mund Hoskins that they know of no other
Charge or Incumberance on the said Estates or
any part thereof and that it is not usual or
customary for Searches to be made by Purchasers
of Estates in Scotland where the Vendors are ge-
nerally reputed to be in opulent Circumstances
and are visibly in Possession of other considerable
Estates Except only in cases where there are
reasonable grounds to suspect such Estates
being charged or incumbered It hath been
agreed that such Searches shall be hereafter
made as soon as conveniently may be And
that the said John Duke of Atholl shall
before or on the first day of December next
Produce and shew to the said Sir Charles Fre-
derick and Edmund Hoskins or the Survivor
of them his Executors or Administrators an
Affidavit or Certificate of some person or
persons having made due and careful
Searches in the proper Office or Offices in
order to discover whether the said Estate
or any part thereof is subject to any other Charge
