Silk Handkerchiefs out of his s^d Ship However the Governor upon repeated
Sollicitations dispensed with the Seizure and directed the said Box of Silk
Handkerchefs should be admitted to an Entry And on the 7^th day of January
following above two Months after the date of the said Commission the said Box
containing eight Dozen of Silk Handkerchefs were entred accordingly- And this
Defendant doth admit that the said prosecutor John Taubman was not sworn in
the said Offices of Captain of Derby fort and Steward of the Demesnes and Garris[obscured]
till the 14^th day of January aforesaid (which might have been postponed upon [obscured]
Occasion) And submits to the Judgment of this Honourable Court the propriety of
the said Act consistent with the principles of Justice and of Gratitude to his
Lord to whom a Duty was due upon the said Box of Merchandize and who had
promised who had granted him the said Commission- And how conformable it
to his said Oath of true faith and fidelity taken the 28^th October 1752 as
aforesaid- And this Defendant doth for greater Certainty crave Leave to refer
himself to the Records and such other proof as he can make in the premises.

brought a Suit against the Defendant for Recovery of certain Shares or parcels
of Land and that the said Cause had been tryed before the Sheading and Trave[obscured]
Jurys under the Jurisdiction and Cognizances of the said prosecutor John Taubman
(who then filled and executed the Character and Office of Deemster) and each
Verdicted for this Defendant And that in the Month of August- Last the
same by Traverse came on to be tryed before the Keys- And this Defendant doth
also admit that when the said Trial was had before the said Keys the said prosecutor
as did also the Attorney General and this Defendant sat promiscuously among

the said Keys And this Defendant was afterwards given to understand that the
said Prosecutor remained in the house of Keys when they were privately
Debating and Determining the Defendants and the several Causes then in Issue and
tryed before them And did presume to interfere [above line: his Seat was vacant for that] his Vote as a Key though he had
presided as Deemster or Judge in this Defendants said Cause, and upon all other
public Occasions he had long before and after, and each day while the said Keys
sat Executed the Office of Deemster- And this Defendant doth insist and will
prove as this Court shall please to direct that it is as inconsistent and
incompatible for a Deemster to sit and vote among the Keys of this Isle as for [obscured]
